Licensing - NSW
NSW Entry Requirements
The Property, Stock and Business Agents Act 2002 requires anyone who
wishes to carry on business as one of the following, to have a license:
- real estate agent
- stock and station agent
- business
agent
- strata/community managing agent or
- on-site residential property manager.
Similarly, those commencing work in the
industry are required to apply for a certificate of registration. Different certificate of registration categories will apply to the different industry
sectors. A certificate of registration may be granted to work as a:
- real estate salesperson
- stock and station salesperson
- business salesperson or
- registered manager.
The requirement to hold a license generally includes anyone providing services
relating to the selling of real estate or the booking of holiday accommodation.
All applicants for a personal license must satisfy the
Commissioner for Fair Trading that he/she is:
- at least 18 years of age
- a fit and proper person to hold a license. Any person in
partnership with a licensee in a property agency must also be a fit and proper person
- has the qualifications required for the license
- is not
a disqualified person
- has paid the relevant contribution to the Property Services Compensation Fund.
All applicants for a
corporation license must satisfy the Commissioner for Fair Trading that:
- the corporation is a fit and proper person to hold a license
- each director of the corporation is a fit and proper person to hold a license
- no director or executive officer is a disqualified person
- at least one of the directors holds a personal license for the industry sector in which the corporation proposes to operate
- the corporation
has paid the relevant contribution to the Property Services Compensation Fund.
All applicants for a certificate of registration must satisfy
the Commissioner for Fair Trading that he/she:
- is at least 16 years of age
- is a fit and proper person to hold a certificate of
registration
- has the qualifications required for the class of certificate of registration concerned
- is not a disqualified
person.
Training Providers
In New South Wales the new Act and Regulations came into effect from 1st September 2003. Part of
those regulations means considerable change to the way sales staff are employed.
From now on, it will not be possible to employ any
salesperson until such time as he or she has completed three units of competency in order to obtain their registration certificate.
